1. These terms
These terms are an agreement between you and Online Painting Estimator LLC, a Washington limited liability company ("Online Painting Estimator", "we", "us"). They apply when you use onlinepaintingestimator.com, request an estimate, or apply to or take part in our painter network. By using the site you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
You must be at least 18 and able to enter a contract. If you use the site for a business, you agree to these terms on its behalf.
2. What we do, and what we don't
Online Painting Estimator gives homeowners an estimated price range for painting projects and connects them with independent painting contractors. We currently serve King, Snohomish, Pierce and Skagit counties in Washington and plan to expand across Washington, Oregon and Idaho.
- We are not a painting contractor. We don't perform, supervise or guarantee any painting work.
- Painters are independent businesses, not our employees or agents. Each painter sets its own prices, schedule and methods.
- Any agreement for painting work is between the homeowner and the painter. We are not a party to it.
3. Estimates are not quotes
The price range you see is an estimate based on typical local pricing and the details you enter. It is not a quote, bid or offer from us or any painter. The actual price depends on what a painter finds when they see the job, including surface condition, prep, access, materials and the painter's own rates. Only a written bid from a painter states what the work will cost.
4. For homeowners
- Getting an estimate and sending a request is free.
- Give accurate details about your project and your property, including the year it was built if you know it.
- When you send a request, you agree that we may share it with painters as described in our Privacy Policy and in the consent you check on the form. A request is never with more than three painters at a time, and your contact details go only to painters who accept it, three at most.
- You are free to accept any bid, or none. Before hiring, we recommend you confirm the painter's license, ask for a written contract and proof of insurance, and agree on scope, price, schedule and payment in writing.
- You pay the painter directly for their work unless we tell you otherwise in writing.
- Please tell us about any problem with a painter at hello@onlinepaintingestimator.com. It helps us keep the network trustworthy.
5. For painters
If you apply to or join our painter network, these terms apply together with your plan and any painter agreement you sign with us. If they conflict, the signed painter agreement controls.
- Accurate information. Everything you submit, including licenses, insurance, bonds, certifications and documents, must be accurate, current and yours.
- Stay licensed and insured. Keep your contractor license or registration, bond (where your state requires one) and general liability insurance active while on the network, and tell us right away if any of them lapse or change. Only accept work on homes built before 1978 if you hold a current EPA lead-safe (RRP) certification and follow lead-safe work practices.
- Follow the law. You are responsible for your work, your crews, permits, taxes, written contracts and compliance with all laws that apply to you, including consumer protection, contractor licensing and lead-safety rules.
- Treat homeowners well. Use homeowner details only to bid on and do the job you accepted. Don't share them, add them to marketing lists, or contact a homeowner who asks you to stop.
- Commission and no bypassing. Your plan states the commission on jobs you win from a request we sent you. Commission is owed on any job for that homeowner at that property that comes from our request and is agreed within 12 months, whether it is booked through the platform or directly. You agree not to avoid commission by arranging the job outside the platform.
- No guarantee of work. We don't promise any number of requests or jobs. Routing depends on your plan, service area, services, availability, budget fit and other factors.
- Suspension. We may decline an application, or pause or remove a painter, for expired credentials, complaints, poor reviews, non-payment, misuse of homeowner information or any breach of these terms.
6. Verification
Before a painter can receive requests, we check that their contractor license or registration is active and review the bond, insurance and other documents they provide. We check again as documents expire. Verification is a point-in-time review of information from the painter and public records. It is not a guarantee of a painter's work, conduct, finances or continued compliance. Homeowners can confirm a painter's status with the Washington Department of Labor and Industries, the Oregon Construction Contractors Board or the Idaho Division of Occupational and Professional Licenses.
7. First-look partner
One of our owners also owns a painting company that participates in the network. In its service area it may be offered a request before other painters, for a limited time. It counts toward the limit of three painters per request, must meet the same license, bond and insurance requirements, and receives homeowner contact details only if it accepts a request, the same as any other painter.
8. Fees
Homeowners pay nothing to use the site. Painters pay according to their plan, which may include a monthly fee and a commission on jobs won. Plan prices, commission rates and payment terms are shown when you choose a plan or set out in your painter agreement. Amounts are in U.S. dollars and do not include taxes, which you are responsible for. Unpaid amounts may lead to suspension. We may change plan prices with at least 30 days' notice; changes do not affect jobs already won.
9. Using the site
Don't misuse the site. That includes submitting false or someone else's information, sending spam or fake requests, scraping or copying painter or homeowner data, trying to get around security or access limits, interfering with the site, or using it for anything unlawful. We may block anyone who does.
10. Content and reviews
The site, our estimator, pricing data, text, design and logo belong to Online Painting Estimator and may not be copied without permission. When you submit content, such as project details, photos, a company description or a review, you keep ownership and give us a non-exclusive, royalty-free license to use it to run and promote the service. For painters, that includes showing your business name, logo, description and reviews on your listing. Reviews must be honest and based on real experience. We may remove content that breaks these terms.
11. Disclaimers
The site and its estimates are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that estimates will match the price you pay, that the site will be uninterrupted or error-free, or that any painter or homeowner will perform as promised.
12. Limits on our liability
To the fullest extent the law allows, Online Painting Estimator is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, or for the acts, omissions, work or products of any painter or homeowner. Our total liability for any claim relating to the site or these terms is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
If you are a painter, you agree to defend and hold harmless Online Painting Estimator and its owners from claims, losses and costs (including reasonable attorneys' fees) arising from your work, your crews, your dealings with homeowners, or your breach of these terms or the law. Any user who misuses the site agrees to do the same for claims arising from that misuse.
14. Disputes and governing law
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Before filing a claim, please email us at hello@onlinepaintingestimator.com so we can try to resolve it informally within 30 days. If we can't, any dispute will be decided in the state or federal courts located in Snohomish County, Washington, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where it qualifies. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
15. Ending your use
You may stop using the site at any time. Painters may leave the network as their plan allows. We may suspend or end access for anyone who breaks these terms. Sections that by their nature should survive, such as commission owed, content licenses, disclaimers, limits on liability, indemnity and disputes, continue after your use ends.
16. Changes to these terms
We may update these terms. We will post changes here with a new effective date, and for material changes we will give notice by email or on the site before they take effect. Continuing to use the site after that means you accept the updated terms.
